RESOLUCION que establece el Mecanismo para garantizar el pago de contribuciones en mercancías sujetas a precios estimados por la SHCP

Primero. Los precios estimados por la Secretaría de Hacienda y Crédito Público son los que se indican en el Anexo 2 de la presente Resolución, publicado en el Diario Oficial de la Federación el 14 de febrero de 2005 y sus posteriores modificaciones, los cuales servirán exclusivamente como referencia y no podrán usarse para determinar la base gravable del impuesto general de importación.
Segundo. Para los efectos de los artículos 36 fracción I inciso e), 84-A y 86-A fracción I de la Ley Aduanera, las personas que importen en definitiva mercancías que sean de las que se mencionan en el Anexo 2 de la presente Resolución y declaren un valor en aduana inferior al precio estimado señalado en dicho Anexo, deberán acompañar al pedimento de importación que corresponda la constancia de depósito o garantía expedida por institución de crédito o casa de bolsa autorizada. El importe garantizado deberá ser igual a las contribuciones y, en su caso, cuotas compensatorias que se causarían por la diferencia entre el valor en aduana declarado y el precio estimado.
Para la operación de las cuentas aduaneras de garantía serán aplicables las disposiciones que correspondan de las Reglas de Carácter General en Materia de Comercio Exterior vigentes.
Tercero. Los importadores que hayan otorgado una garantía en términos de los artículos segundo y sexto de la presente Resolución, deberán contar con la factura certificada o el informe de verificación que cumpla con los requisitos establecidos en el artículo octavo de la presente Resolución y ponerlos a disposición de la autoridad cuando ésta así lo requiera.
Cuarto. Los importadores podrán solicitar la cancelación de la garantía otorgada en los términos de los artículos 86-A de la Ley Aduanera y segundo de la presente Resolución, presentando ante la institución de crédito o casa de bolsa emisora de la constancia de depósito o garantía correspondiente, copia del pedimento de importación y el ejemplar de dicha constancia destinada al importador, siempre que la autoridad aduanera no haya avisado a la institución de crédito o casa de bolsa de que se trate el inicio del ejercicio de sus facultades de comprobación.
Quinto. Cuando vencido el plazo de 6 meses a que se refiere el artículo 86-A, fracción I de la Ley Aduanera, el contribuyente no retire de la institución de crédito o casa de bolsa los depósitos en cuenta aduanera de garantía, éstos se transferirán con sus rendimientos a la Tesorería de la Federación, quedando a salvo durante 2 años los derechos del contribuyente para solicitar su devolución ante la autoridad competente, de lo contrario dichos depósitos prescribirán en los términos del artículo 36 de la Ley del Servicio de Tesorería de la Federación.
Sexto. Las personas morales que tributen de acuerdo con lo dispuesto en los Títulos II y II-A de la Ley del Impuesto sobre la Renta podrán optar por otorgar una garantía global que ampare las importaciones que efectúen en un periodo de seis meses, en lugar de garantizar individualmente cada operación. Lo anterior no será aplicable a quienes importen por primera vez mercancías sujetas a precios estimados o a quienes hayan importado dichas mercancías en el semestre inmediato anterior cuando el valor en aduana promedio declarado por las mismas, haya sido inferior en más de un 30% al precio estimado para dichas mercancías, vigente al momento de efectuarse las importaciones. La garantía global se otorgará conforme a lo siguiente:
I. Se otorgará una garantía inicial igual al 90% de la diferencia entre las contribuciones y cuotas compensatorias que se hubieran causado por las importaciones efectuadas durante el semestre inmediato anterior con base en los precios estimados vigentes al momento de la importación, y las efectivamente pagadas con base en el valor en aduana declarado, sin que en ningún caso pueda ser inferior a $100,000.00.
II. Cuando la diferencia que resulte de disminuir al importe acumulado de las contribuciones y cuotas compensatorias que se causarían por las importaciones efectuadas desde el inicio del semestre garantizado con base en los precios estimados vigentes al momento de la importación, las contribuciones y cuotas compensatorias efectivamente pagadas por las mismas importaciones con base en el valor en aduana declarado, exceda en más de un 15% al importe total garantizado conforme a la fracción I de este artículo, el importador deberá otorgar durante los primeros 15 días naturales del mes siguiente a aquél en que se haya dado este supuesto, una garantía adicional equivalente a dicha diferencia.
III. El importador que se ubique en el supuesto señalado en la fracción II, deberá otorgar por cada uno de los meses subsiguientes del semestre garantizado, una garantía adicional por una cantidad igual a la diferencia que resulte de disminuir al importe mensual de las contribuciones y cuotas compensatorias que se causarían por las importaciones efectuadas durante cada mes con base en los precios estimados, las contribuciones y cuotas compensatorias efectivamente pagadas por las mismas importaciones con base en el valor en aduana declarado. Dicha garantía deberá presentarse durante los primeros quince días naturales siguientes a cada uno de los meses señalados.
IV. Cuando el importe de las contribuciones y cuotas compensatorias que se causarían por las importaciones de mercancías sujetas a precios estimados efectuadas durante el semestre garantizado con base en el precio estimado vigente al momento de la importación, disminuido de las contribuciones y cuotas compensatorias efectivamente pagadas por las mismas importaciones con base en el valor en aduana declarado, sea mayor que el importe garantizado conforme a las fracciones I, II y III de este artículo, el importador deberá presentar una garantía adicional que ampare la diferencia, dentro de los diez días naturales siguientes a la fecha en que concluya el semestre amparado por la garantía.
Para sujetarse a lo dispuesto en este artículo, el importador deberá presentar una solicitud de autorización ante la autoridad competente que corresponda a su domicilio fiscal, en la que deberá señalar el valor en aduana promedio al que se hubieran importado las mercancías sujetas a precios estimados durante el semestre anterior, el importe total de contribuciones y cuotas compensatorias causadas por las importaciones efectuadas en dicho semestre y el importe total de las contribuciones y cuotas compensatorias que se hubieran causado con base en el precio estimado vigente al momento de la importación. La autoridad competente deberá emitir la resolución que corresponda en un plazo no mayor a quince días. En el oficio de autorización se señalarán los datos del importador, el importe de la garantía y el plazo que ampara.
Quienes obtengan la autorización a que se refiere este artículo, deberán anexar copia del oficio de autorización a cada pedimento de importación y deberán anotar en el campo de observaciones del pedimento, el número y fecha del oficio que expida la autoridad competente.
Quienes se sujeten a lo dispuesto en este artículo, no podrán cambiar de opción durante un plazo de dos años, por lo que antes del vencimiento del semestre garantizado, deberán efectuar los trámites correspondientes para el otorgamiento de la garantía global que ampare las importaciones que vayan a efectuar durante el semestre siguiente. En el caso de no cumplir con lo anterior, no podrán sujetarse a lo dispuesto en el presente artículo durante los dos años posteriores al vencimiento de dicho semestre.
Procederá la cancelación automática de la autorización para el otorgamiento de la garantía global cuando se dejen de cumplir los requisitos que dieron lugar a la autorización o las obligaciones previstas en la presente Resolución, así como cuando el importador incumpla con sus obligaciones fiscales o por resolución firme en la que se determinen créditos fiscales omitidos.
Séptimo. Los importadores que hayan otorgado una garantía global en los términos del artículo sexto de la presente Resolución, podrán obtener su liberación en un plazo menor al previsto en el artículo 86-A, fracción I de la Ley Aduanera, siempre que haya transcurrido un plazo de tres meses a partir de la fecha en que venza el semestre amparado por la garantía global, para lo cual deberán presentar dentro de los veinte días siguientes a la fecha de conclusión de dicho semestre, solicitud de autorización ante la misma autoridad que haya autorizado la garantía global, acompañada de las copias de los pedimentos de importación, copia de la constancia de depósito o garantía y las facturas certificadas o los informes de verificación por embarque, de las mercancías importadas al amparo de la garantía, que reúnan los requisitos establecidos en el artículo octavo de esta Resolución. La autoridad competente deberá resolver en un plazo no mayor a tres meses a partir de la fecha de conclusión del semestre garantizado. D.O.F. 06/07/2004
En los casos en que proceda la autorización a que se refiere el párrafo anterior, para la liberación de la garantía, el importador deberá presentar ante la institución que haya emitido la constancia de depósito o garantía, la solicitud de liberación de la garantía, el oficio de autorización de liberación de la garantía emitido por la autoridad competente y el original del ejemplar de la constancia de depósito o garantía destinada al importador.
En ningún caso la institución que haya emitido la constancia de depósito o garantía procederá a la liberación anticipada a que se refiere el párrafo anterior, cuando la autoridad hubiere iniciado el ejercicio de facultades de comprobación.
Octavo. Las facturas certificadas y los informes de verificación que los importadores están obligados a tener y exhibir cuando las autoridades así lo requieran, en términos del artículo tercero de la presente Resolución, deberán reunir los siguientes requisitos:
I. La factura que ampare cada importación, certificada por la autoridad competente del país en que resida el proveedor. En el caso de que la certificación de la factura haya sido proporcionada en idioma distinto del español, inglés o francés, se deberá anexar la traducción al idioma español.
Para efectos de esta fracción, se consideran autoridades competentes, las que conforme a la legislación del país de residencia del proveedor tengan atribuciones para certificar dichas facturas. A falta de disposición expresa, se considerarán autoridades competentes las Cámaras de Comercio o de Industria de dicho país y, en defecto de las anteriores, los consejos de industria manufacturera, los consulados o las federaciones de industria.
II. Un informe de verificación sobre el precio pagado o por pagar por las mercancías de que se trate, siempre que la verificación se hubiere realizado dentro de los sesenta días naturales anteriores a la importación definitiva.
El informe de verificación deberá ser expedido por una entidad de inspección previa, reconocida por la Secretaría de Economía, en los términos de las Reglas de operación de las entidades de inspección previa reconocidas para expedir informes de verificación, publicadas en el Diario Oficial de la Federación el 10 de septiembre de 1998.
Noveno. Cuando se realicen importaciones de mercancías sujetas a precios estimados y la unidad comercial de dichas mercancías no corresponda a la establecida en el Anexo 1 de esta Resolución, se deberá aplicar la resolución aun y cuando no sea la misma unidad comercial. D.O.F. 21/04/2008
Para tal efecto, se considerará que el precio estimado aplicable es aquel que resulte de multiplicar el precio establecido en esta Resolución para la mercancía de que se trate por el resultado que se obtenga de dividir la unidad comercial de las mercancías importadas entre la unidad comercial establecida en el Anexo 1 de esta Resolución para las mercancías de que se trate.
En el caso de que las unidades de medida de las unidades comerciales no sean comparables entre sí, antes de realizar las operaciones establecidas en el párrafo anterior, las unidades de medida de las unidades comerciales de las mercancías importadas se convertirán a las unidades de medida de la unidad comercial establecida en esta Resolución.
Décimo.- El Anexo 2 de la presente Resolución no es aplicable a las importaciones de vehículos que tengan un peso bruto vehicular inferior o igual a 8,864 kilogramos, si su número de serie o año-modelo tiene una antigüedad igual o mayor a 30 años respecto al año-modelo vigente. D.O.F. 24/03/2010
Décimo Primero.- Quienes efectúen importaciones definitivas de vehículos usados para permanecer en la franja fronteriza norte, en los estados de Baja California y Baja California Sur, en la región parcial del Estado de Sonora y en los municipios de Cananea y Caborca en el Estado de Sonora, podrán optar por no garantizar de conformidad con el artículo 86-A, fracción I de la Ley Aduanera, siempre que, de conformidad con los lineamientos que para tales efectos emita el Servicio de Administración Tributaria, el proveedor en el extranjero transmita electrónicamente la información relacionada con el vehículo usado de que se trate, así como el precio de venta respectivo, y se efectúe la validación previa de los datos contenidos en el pedimento de importación correspondiente, considerando la información trasmitida, en términos del artículo 38 último párrafo de la Ley Aduanera. Lo dispuesto en el párrafo anterior no será aplicable cuando el importador tenga créditos fiscales exigibles que no se encuentren pagados o garantizados en alguna de las formas establecidas en el Código Fiscal de la Federación o en los casos en que haya obtenido cualquier resolución judicial que lo exima de la aplicación de los precios estimados contenidos en el Anexo 2 de la presente Resolución, salvo que acredite haber presentado escrito de desistimiento del medio de defensa, que el mismo haya sido ratificado ante el juez competente y este último haya acordado favorablemente el desistimiento.
Los proveedores en el extranjero interesados en efectuar la transmisión electrónica de la información a que se refiere el párrafo anterior deberán presentar ante la Administración General de Aduanas del Servicio de Administración Tributaria, una solicitud de registro que contenga el nombre, denominación o razón social de la empresa de que se trate, domicilio para oír y recibir notificaciones, dirección de correo electrónico y teléfono, anexando la documentación con la que acredite lo siguiente:
a) Ser una empresa legalmente constituida en el país de su residencia, dedicada exclusivamente a la enajenación de vehículos automotores;
b) La representación legal de la persona física que actúe en su nombre;
c) Tener al menos cinco años de haber iniciado operaciones de enajenación de vehículos usados, y
d) Contar con sus estados financieros auditados a través de contadores públicos certificados en su país de residencia, cuando menos de los últimos dos años.
La Administración General de Aduanas del Servicio de Administración Tributaria, previa opinión de la Unidad de Política de Ingresos, y una vez revisada la información y documentación a que se refieren los incisos anteriores, dará a conocer a través de la página electrónica www.aduanas.gob.mx, el nombre de los proveedores en el extranjero que estén en posibilidad de transmitir electrónicamente la información a que se refiere este artículo.
Los proveedores en el extranjero deberán efectuar la transmisión electrónica de la información y proporcionar la información y documentación requerida por la autoridad aduanera en los términos señalados en los lineamientos que para tales efectos emita el Servicio de Administración Tributaria.
En caso de que se detecten posibles irregularidades en la información trasmitida por el proveedor y éste no proporcione la información o documentación que le sea requerida, se cancelará su registro.
Lo anterior, sin perjuicio del ejercicio de las facultades de comprobación que lleve a cabo la autoridad aduanera.

DISPOSICIONES TRANSITORIAS
Primera. La presente Resolución y el "Anexo de la Resolución que Establece el Mecanismo, para Garantizar el Pago de Contribuciones en Mercancías Sujetas a Precios Estimados por la Secretaría de Hacienda y Crédito Público" entrarán en vigor el 15 de marzo de 1994.
Segunda. Se abroga a partir de la fecha en que la presente Resolución entre en vigor la "Resolución que Establece el Mecanismo para Garantizar el Posible Pago de Contribuciones en los Casos de Subvaluacíon de Mercancías de Importación", publicada en el Diario Oficial de la Federación el 16 de noviembre de 1993, y el "Anexo de la Resolución que Establece los Precios Estimados de Mercancías Objeto de Subvaluación", publicado en el Diario Oficial de la Federación el 4 de agosto de 1993, y reformado en su título para ser el "Anexo de la Resolución que Establece el Mecanismo para Garantizar el Posible Pago de Contribuciones en los Casos de Subvaluación de Mercancías de Importación", publicado en el Diario Oficial de la Federación el 16 de noviembre de 1993.
Tercera. Lo previsto en el ARTÍCULO SEXTO de esta Resolución será aplicable a las fianzas individuales que se hubieran presentado para garantizar el posible pago de contribuciones, de conformidad con la "Resolución que Establece los Precios Estimados de Mercancías Objeto de Subvaluación, para Efecto de que los Importadores Garanticen la Posible Diferencia de Contribuciones entre los Citados Precios y los Valores Declarados por el Importador", publicada en el Diario Oficial de la Federación el 4 de agosto de 1993 y la "Resolución que Establece el Mecanismo para Garantizar el Posible Pago de Contribuciones en los Casos de Subvaluación de Mercancías de Importación", publicada en el Diario Oficial de la Federación el 16 de noviembre de 1993. El plazo de 30 días a que se refiere el mencionado ARTÍCULO SEXTO se computará a partir de la entrada en vigor de la presente Resolución.
DISPOSICION TRANSITORIA D.O.F. 06/07/2004.
Única. La presente Resolución entrará en vigor el 1 de agosto de 2004.

Única. La presente Resolución entrará en vigor al día siguiente al de su publicación .

Primero.- La presente Resolución entrará en vigor al día siguiente de su publicación en el Diario Oficial de la Federación.
Segundo.- El Anexo 2 de la presente Resolución, no es aplicable para las empresas comerciales de autos usados residentes en la franja fronteriza norte del país, en los estados de Baja California y Baja California Sur, en la región parcial del Estado de Sonora y en el municipio fronterizo de Cananea, Estado de Sonora, que efectúen la importación definitiva de vehículos usados al amparo del “Decreto por el que se establecen las condiciones para la importación definitiva de vehículos automotores usados, por parte de empresas comerciales de autos usados, destinados a permanecer en la franja fronteriza norte del país, en los estados de Baja California, Baja California Sur, en la región parcial del Estado de Sonora, y en el municipio fronterizo de Cananea, Estado de Sonora”, publicado en el Diario Oficial de la Federación el día 8 de febrero de 1999.
